Alan Dershowitz: Today is a 'very dangerous day for lawyer-client relations'

Reacting to FBI raids Trump lawyer's office.
The FBI on Monday raided the office of President Trump's personal lawyer, Michael Cohen, and seized emails, tax documents and records related to his payment to adult-film star Stormy Daniels.

Cohen's lawyer, Stephen Ryan, said in a statement that federal prosecutors in Manhattan obtained a search warrant after receiving a referral "in part" from special counsel Robert Mueller. Ryan called the search “completely inappropriate and unnecessary.”

The New York Times reported that the payment to Daniels is just one of "many topics" being looked at by the FBI.

Other seized documents include business records and communications between Cohen and Trump, but the raid does not appear to be directly connected to Mueller’s probe of Russian meddling in the 2016 election, according to The Times.

Among the materials agents secured are those related to Cohen’s $130,000 payment to Daniels as part of a nondisclosure agreement related to her alleged 2006 affair with Trump....

    Dershowitz:
Harvard Law professor Alan Dershowitz warned Monday that special counsel Robert Mueller's decision to raid President Trump's personal lawyer's office is an assault on the privileged lawyer-client relationship.

Dershowitz said on Fox News that he believes the decision to raid Michael Cohen's office would be a sign that Mueller is trying to turn Cohen against Trump.

"This may be an attempt to squeeze Cohen," he said. "He's the lawyer, he's the guy who knows all the facts about Donald Trump, and to get him to turn against his client."

"This is a very dangerous day today for lawyer-client relations," he added.
"If this were Hillary Clinton being investigated and they went into her lawyer's office, the ACLU would be on every television station in America, jumping up and down," he added.
The FBI has no credibility. Mueller & Co. are clearly in for a penny, in for a pound.

All I can say is that there was sufficient evidence to convince the US attorney, a Trump appointee to pursue it, and from what lawyer friends tell me, a warrant for the communications of a lawyer is a very rare thing to grant.

The problem is, is that we are being told this is not related to the Trump investigation. How fortuitous that they may be able to stumble across "something" while investigating his lawyer.

      I smell a rat.

I thought this "raid" was carried out by the DOJ's Southern District of New York and not the Special Counsel's Office.

              Very rare indeed.

Trump lawyer Michael Cohen could face up to 30 YEARS in prison for felony bank fraud if he paid Stormy Daniels $130,000 by lying to secure a home equity line

From what I understand from news reports yesterday on CNBC, this was something Mueller ran across and gave to the DOJ's S D of NY to investigate because it didn't fall within his investigation.

It should only happen when there is substantial credible evidence that the attorney actually facilitated a criminal act. And then, in my opinion, only to prosecute the lawyer. This is starting to look like a personal vendetta or someone looking to become a legend.

If that is the case, Alan Dershowitz is not clear on what occurred and is basing his opinion on incorrect information.

Dershowitz's concern is not what specific individual conducted this circus; it's the effect on every public defender and every PD's clients, everyone accused of a crime and his or her attorney, every civil-rights plaintiff and his/her attorney; every small business operator or property owner who tries to fight city hall, and so on. It's using the power of government to intimidate and coerce and ultimately force a massive breach of attorney/client privilege. The government has tried (and occasionally succeeded) in doing this to union lawyers, and I was against it then (as was Dershowitz, IIRC).

Just because Trump and his people denigrate and subvert the Constitution doesn't excuse it when someone else in government does the same to get to Trump. The ends do not justify the means.

No, it goes to the heart of his complaint. You cannot make the claim that the Special Counsel's Office is trying to squeeze Cohen in order to get Trump if they aren't the ones exercising the search warrant. If Mueller wanted Cohen in the hot seat, he would have put him there himself.

As far as the concern about attorney-client privilege, I agree but sometimes, lawyers commit crimes too.
