U.S. appeals court denies request to restore Trump's immigration ban

Reuters | By David Shepardson | 38 mins ago
Feb 5 (Reuters) - A U.S. appeal court late on Saturday denied an emergency appeal from the U.S. Department of Justice to restore a immigration order from President Donald Trump barring citizens from seven mainly Muslim countries and temporarily banning refugees.

"Appellants' request for an immediate administrative stay pending full consideration of the emergency motion for a stay pending appeal is denied," the ruling by the U.S. Court of Appeals for the Ninth Circuit said.

It said a reply from the Department in support of the emergency appeal was due on Monday.

The Department filed the appeal a day after a federal judge in Seattle ordered Trump's travel ban to be lifted. The president's Jan. 27 order had barred admission of citizens from the seven nations for 90 days.

This comes on the heels of a judge in Seattle lifted the travel ban temporarily. I couldn't remember which thread we were discussing this issue, if any, so figured it's breaking news and might as well go here.

I have a feeling we're in for a lot of back-and-forth wrangling over these EO's as they get challenged in court.

Here's a second one, if that's actually important to you.

If the Leftists keep this up then they might get their wish- authoritarian government.

Not a hater. A realist. And proven right.

That's three now. Or as we call it, plural.

If it's the plan that democrats to continuously challenge Trump's agenda, those court challenges will go into the meaningless column...unless, of course, they are used by those same democrats to say that Trump's EO's are challenged more than any other president's.

Isn't that what Trump is doing with repeated executive orders? He's not running anything by congress that he doesn't have to and his party has the control. What does that say?

His party in congress are a bunch that should be wearing those cute little pink hats like those worn in the womens march, the "leadership" at least.
Trump did not write a law nor change a law with the immigration EO, he wants a temporary halt to better know who &/or what is getting into the US.

When I worked in retail, we had 2 store security/loss control "officers" whose job it was to prevent shoplifting and catch shoplifters. This was in Northern Virginia in the mid-1970s. I was a fledgling assistant store manager, and learning about security was part of my training.

The security people explained to me that most of the shoplifting was done by black people and "foreigners." I was told to watch these people carefully and page security (there was a secret code for this page, so as not to alert the miscreants they were being watched) if they acted furtive. Apparently, "acting furtive" included breathing while shopping, because these 2 spent their entire shifts following around people who fit their profile. They had other codes, too. The very subtle "red dot alert" let security know there were East Indians in the store.

I figured these folks were right on top of that suspicious person thing, so I watched everyone else. I watched white boys from The Citadel (according to their letter jackets) steal magazines, clothing and cigarettes, while security followed around a black family shopping for shoes. I have no idea what various upstanding white citizens made off with while I was dragooned into interpreting from English to Spanish as security grilled a young woman they suspected of stealing clothes, who emptied out her purse and pockets willingly to show she had not taken anything. They let her go eventually, but they were sure she had managed to pass the merchandise off to a confederate somehow.

My concern with country-specific bans (or whatever you want to call them) is that it's putting all our eggs in one, possibly defective basket.

                        Sept. 11, 2001 attack: 2,996 dead

All other murders in 2001: 15,980 dead.

Absolute numbers for gang-related murders would require more digging, but at least 1300 of the non-terrorism related murders involved gang members, and that number is only for cities over 100K in population.

There definitely needs to be careful screening of immigration applicants. My question is, is our government currently so focused on anti-terrorism measures that resources for other public safety programs are at risk? And are we watching people from Islamic countries and/or with Muslim names exclusively, while equally dangerous people slip through the net?

Court Refuses to Reinstate Travel Ban, Dealing Trump Another Legal Loss

                          https://nyti.ms/2kUaROJ
WASHINGTON — A three-judge federal appeals panel on Thursday unanimously refused to reinstate President Trump’s targeted travel ban, delivering the latest and most stinging judicial rebuke to his effort to make good on a campaign promise and tighten the standards for entry into the United States.

The ruling was the first from an appeals court on the travel ban, and it was focused on the narrow question of whether it should be blocked while courts consider its lawfulness. The decision is likely to be quickly appealed to the United States Supreme Court.

That court remains short-handed and could deadlock. A 4-to-4 tie in the Supreme Court would leave the appeals court’s ruling in place.

Trial judges around the country have blocked aspects of Mr. Trump’s executive order, which suspended travel from seven predominantly Muslin countries and limited the nation’s refugee program, but no other case has yet reached an appeals court.

Looks like it was unanimous, not divided 2:1 over party lines.

This is crazy. What they are saying is that no one can stop these people from coming in. Can Trump fight back? Maybe by stopping ALL immigration?
