OMG... My Quarter Pounder with Cheese has cheese on it.

    The Horror

Two Florida residents, Cynthia Kissner and Leonard Werner, had one too many cheese slices on their burger when they wanted it plain. So they did as any reasonable person would do... Just kidding, they didn't. They took it to court.

Leonard Werner was the instigator. He allegedly stopped wanting cheese on his Quarter Pounders for dietary reasons. (And a cheese-less Quarter Pounder is that much better?!) After making the switch to plain burgers, he was upset that he was still being charged the same amount.

At the drive-through window, the options are listed as: Quarter Pounder with Cheese ($4.19) and Double Quarter Pounder with Cheese ($6.19). The McDonald's app allows for customizing, but Werner felt compelled to purchase the burger with cheese and was distressed that he had to remove it without a price deduction. He took his complaints to a lawyer, and the lawsuit was put into action.

A man by the name of Andrew Lavin decided to file this lawsuit. To give you any insight about his profile, a simple Google search will tell you he's only been reviewed once, likely by this cheese-hating dream team.

He busted out his big boy work to find out that the cheese costs a cool .20-.40 cents extra. In Lavin's eyes, this was enough for a lawsuit. He came up with a 32-page lawsuit, claiming that the plaintiffs "suffered injury" because they were "overcharged."

Lavin also claimed that McDonald's violated the anti-trust laws by not explicitly stating that cheese comes on the Quarter Pounders. The argument was that they were "overcharged and compelled to pay for unwanted cheese."

McDonald's may allow its customers to add or remove certain items, but keep in mind: the Quarter Pounder is advertised as a quarter-pound beef patty served with two slices of American cheese, slivered onions, and tangy pickles on a sesame seed bun. Customize it however you want, but you're charged for the entire order. Sounds pretty fair, right?
If anything they should be sued for calling that yellowish orange chemical composition cheese.
    We are so fucked.

How hard is it to remove the cheese or just order a plain burger?

I seriously don't know. I customize my few McDonald burgers by giving Jack the top bun (he claims they are delicious). That's about as far as I customize anything.

Kinda depends. Sometimes the cheese is actually melted onto the patty, which makes it essentially impossible. Sometimes it isn't melted at all, which means one could easily remove it and fling it to see if it sticks to the ceiling.

These kids today. Why, back in my day, if we wanted to file a lawsuit against McDonalds, we had to fucking injure ourselves with hot coffee.
        Enjoy.

I was shocked one day when I ordered my Chick-Fil-A sandwich without the bun and they charged me less for it because I wasn't getting the bun. Now, that's service. The employee was actually a tad annoyed that I told him they could keep the bun after I'd already ordered everything...he was irritated because he had to adjust the price. But, typical of chick-fil-a service, the irritation was very short lived. He seemed surprise by my surprise about the price adjustment.

Most places charge me the exact same price even if I'm getting an omelet but no potatoes and no side of meat, etc.

            Great for Chick-fil-A!

My experience is like yours mostly and I don't get mad about it. If I really want something super-custom, I order off the à la carte menu or just make a request. I've never had a place that sold steak tell me I couldn't just have a steak and mushrooms - nothing else.

It never occurred to me to play around with a fast food menu. It's specified food. If I hated curry (and I kind of do), I would not make them give me a curry item but without curry. I'd get the tandoori chicken and nan instead. That's about my speed in terms of spices.

I should have kept this and sent it in to Leno or something. I got a heat-and-eat something-or-other one day probably 20 years ago for lunch at the office one day. Some off-brand thing I picked up at the dollar store. When I opened it up, the instructions read:
                  MICROWAVE (1000 W):

                  Heat on high until hot.

HRH's go-to food for unfamiliar restaurants is a grilled cheese. Very hard to screw up so badly it's inedible. Sadly, no fast food restaurants offer grilled cheese. If we eat at McD's, which one can at least count on not to give one ptomaine, she orders the cheeseburger, no meat. Nobody bats an eye. It even comes up correctly on the drive-through confirmation screen. We don't expect a discount and they don't say anything about weird requests.

We don't sue - or even complain - that they don't charge us less for no meat. They're accommodating a special request.

The idiot quotient is high out there.

Here's the flip side. We get back into South Lake Tahoe after driving a bunch of really scary roads on one of our adventures, and we're really hungry and tired and the dogs want dinner too. We go to the Sno-Flake Drive-Up (not drive-in; no, somebody has to get out in the freezing cold and go into this burger shack), where last year she got a grilled cheese and really good fries, even though the grilled cheese isn't on the menu. I go in and order a burger, fries to share, and a cheeseburger with no meat. Oh no. The cook won't do that because they got a new grill and it tends to burn the bun. I say I'll take the risk. Nope. Can't do it. Finally found a sit-down restaurant (we couldn't eat in because the dogs) that took pity on a frazzled mother on vacation (ok, I failed to mention that the "child" in question had just turned 23) and made her a grilled cheese to go. It was only adequate, but I gave them a rave review for service.

As I was reading the story, I knew to expect the unexpected because Florida, but I was thinking it would be a lawsuit because he asked for no cheese but they put it on there, anyway.

I'd rather chew a zombie's fingernails for lunch than eat at McDonald's, but my mother who longer drives likes their all-day breakfast options so I'm there a lot more than I'd like. For her, I choose to starve.

Anywho, there's a 50/50 chance of them putting cheese on something that has been requested as "no cheese". Since it's usually a breakfast biscuit, the cheese always melts into the bread and sausage so it tears the entire thing apart trying to remove it.

Even more strange is they have a separate menu item - sausage biscuit, versus sausage with cheese biscuit - and they STILL get it wrong half the time.
