Health workers that volunteered to come to NY during pandemic have to pay state income tax: Cuomo

NEW YORK — Health care workers that came to New York to help fight the coronavirus pandemic at its epicenter will have to pay state taxes, according to the governor.

He addressed the issues Tuesday at a news conference.

"We're not in a position to provide any subsidies right now because we have a $13 billion deficit," Gov. Andrew Cuomo said. "So there's a lot of good things I'd like to do, and if we get federal funding, we can do, but it would be irresponsible for me to sit here looking at a $13 billion deficit and say I'm gonna spend more money, when I can't even pay the essential services."

Even though the state government asked thousands of people to come to New York from out of state to help fight coronavirus, they will have to pay New York state taxes, even on income they might make from their home states that they're paid while in New York.

Cuomo said he needs help from Washington in order to cover budget deficits from COVID-19, let alone subsidize state income tax for essential workers that flocked to New York's aid.

"If we don't get more money from Washington, we can't fund schools, right, so at the rate we want to fund them. We are in dire financial need," he said.

The issue first came up when the temporary hospital in Central Park was being erected by Samaritan's Purse.

"Our financial comptroller called me," said Ken Isaacs, a vice president of the organization, "and he said, 'Do you know that all of you are going to be liable for New York state income tax?'

"I said, 'What?'" Isaacs continued. "[The comptroller] said, 'Yeah, there's a law. If you work in New York State for more than 14 days, you have to pay state income tax.'"

"I didn't know that," Isaacs told PIX11 News.

"What we're even more concerned about than the money," Isaacs continued, "is the bureaucracy, and the paperwork, and I think that once that's unleashed...once you start filing that, you have to do that for like a whole year or something."

A top New York City certified public accountant explained the situation further in a FaceTime interview with PIX11 News at the time.

Entities from "these other states will have to register in New York," said Lawrence Spielman, a partner at the accounting firm Spielman, Koenigsberg & Parker, LLP, "and do withholding here in New York."

Any out-of-state resident who's come to the Empire State to work on coronavirus relief is subject to the tax after 14 days here.

There are thousands of emergency workers here who've responded to requests by Cuomo and Mayor Bill De Blasio for help. Many of them are collecting paychecks from companies back in their home states, which allowed them to come to New York to volunteer.
Bite that hand that feeds you. Bite it as hard as you can.

Whitmer and Cuomo must be having a contest for stupid sound bite of the day.

It is not a subsidy. These people are coming from out of state, spending ridiculous amounts of money for food, lodging. And you are seriously so lacking in gratitude for their help and sacrifice that the State of New York, and most likely the City of New York as well, are saying thank you by asking them to go through the horseshit of filing and paying income tax for a few hundred bucks?

I guess someone has to cough up the bucks for NY to truly subsidize and spend more money on illegals.
    We are so fucked.

I remember fleets of utility workers on Long Island following Hurricanes Irene (2011) and Sandy (2012). Andrew Cuomo was governor for both.

I don't remember learning that he sought taxes from those utility volunteers.

I should imagine that would set a legal precedent, past practice and all. Plus the "optics" of picking the pockets of these Good Samaritans is too silly to hide.

        I'll play Devil's Advocate here.

Most of the healthcare workers going to "help" NY are not volunteering. On average they are making three times the hourly amount they are used to and all travel and housing arranged by agencies. Sure there's tons of FB details about going to the front lines and helping and yes it's potentially hazardous duty as I personally know two ER nurses now COVID + from a NY temp gig.

So yes, they should pay State Income tax. They are working like anyone else.

When we were traveling nurses one year I had five state income tax forms plus the fed forms to keep my accountant busy. I was well paid at the time for that honor. So are these NY fill ins.

That would be akin to localities (NY at least) taxing visiting professional athletes. The Atlanta Braves pay tax to NYC when they visit the Mets, for example.

I think that's pretty cheeky. But more, in the present case, we've been making much of the risk and heroism of the medical people (too much, really). To turn around and tax them for the effort is churlish.

Who's paying them? NY? Then pay the Gotham taxes. But if their checks are written elsewhere, let that be the area they're responsible to.

A few years ago after one of the hurricanes down south, the federal government paid government workers to go there to help rebuild. Hell, they even paid family members, I believe that went along. I believe our state did that as well.

I don't know if all states are the same, but in my experience, Frostbit's correct. You pay tax where you earn the money. When I worked in California for Atlanta-based Crawford & Company, our paychecks came from Georgia, but we worked in CA and paid only CA taxes, not Georgia.

And when hospitals import nurses, whether from the Philippines or Iowa (and I've known both), they are, in fact, provided housing and transportation.

                    1. They are volunteers. They would not have lost their jobs if they didn't choose to go.
                    2. Who cares how much they are making? We're shoveling boatloads of cash to businesses just to keep people paid - even if they don't have anything to do.
                    3. Regardless of your situation (non National Emergency), it's bullshit to further complicate their lives and further disincentivise people from answering the call to choose to go to New York the next time this happens.
                    4. These are not "traveling nurses" by trade. Most don't have accountants and shouldn't have to worry about those things right now - but a politician sees a pile of money so....

If I'm a traveling sales rep for some company in NC, say. My career is selling out of state, drawing up agreements out of state.

Do I pay those various states taxes out of my salary or commission?

I remember a story eons ago about a lawyer who was feted by his law firm because due to time zones and long flights, he was able to log more than 24 billable hours in a day.

                        Where did he owe taxes?

Now I'll grant, the taxers have probably wrangled a legal way to tax the air we breathe, if we let them.

But if you're a cook in my restaurant in PA, and I give you a paid month off to cook, for free there, for first responders in NYC, I simply don't believe NY is entitled to a cut of your salary.

If you have law on your side, pound the law, as they say. I'm pounding principle.
Traveling sale reps pay taxes where their paychecks go, i.e., their state of residence, precisely because that is their fixed base of operations. Traveling nurses, as Frostbit noted, pay taxes wherever they earn the money, because they reside, however temporarily, in that state. Some of them don't even have fixed addresses, or they have a home someplace they intend to retire, but never stay there. There are different rules for different situations. If these are true volunteers, and their employers back home are paying them, out of the goodness of their hearts, to go to NYC, those volunteers aren't earning money in NYC, and therefore aren't affected. If they're agency or registry nurses who "volunteered" to go get paid to work in NYC, their home state can't tax that money, so of course NY can.
"Since the historic ruling, the Lovings have become icons for equality. Mildred released a statement on the 40th anniversary of the ruling in 2007: 'I am proud that Richard’s and my name is on a court case that can help reinforce the love, the commitment, the fairness, and the family that so many people, Black or white, young or old, gay or straight, seek in life. I support the freedom to marry for all. That’s what Loving, and loving, are all about.'." - Mildred Loving (Loving v. Virginia)

This!! I support the Doctors and Nurses "on the front lines"....... that said there are plenty on Facebook wearing this like a badge of honor while they are there for the gold mine. Sorry but that's disingenuous in my mind.
